Fax Filing
The clerk of court accepts fax filing of any
pleading pursuant to LSA-R.S. 13:850. Note that a "receipt of
transmission" must be transmitted by the clerk to the sender in
order to complete the filing.
A fax filing is effective only if the original signed document is
received by the clerk's office within five days of the fax transmission
and the applicable filing fee and five-dollar transmission fee are paid.
When one is facing a prescription deadline,
he should phone the clerk in advance of the fax filing if he needs a clerk
to issue the receipt of transmission after regular working hours on the
date of the fax transmission. A fax
submission will not be considered filed until the acknowledgment of
receipt can be transmitted. See LSA-R.S. 13:850 (A).
