Fees

The clerk of court’s office does not receive ad valorem taxes. Its operations are entirely funded by the collection of fees for services it provides. The Louisiana Legislature establishes the clerk of court’s fee schedules, and we have developed this as a guide to assist you in estimating costs. The clerk of court accepts credit cards in all areas with the exception of the marriage license department.

Civil Divisions – 24th Judicial District Court, First Parish Court, Second Parish Court
All fees herein are established in accordance with La. R.S. 13:841 (as amended by Act No. 243 of the 2006 Regular Legislative Session) and other relevant statutes. This Fee Schedule is intended only as a guide in estimating costs.  For assistance with calculating costs for your pleading or filing, call (504) 364-3740.  However, please realize that every pleading is different and may include the need for services or include attachments or other documents that may increase the cost to process accordingly. If you believe these charges might be incorrect, contact our civil suit accounting department at (504) 364-2655 or (504) 364-2912 for a formal review.  At any time during litigation, any party may request and obtain a copy of the docket ledger.The following schedule of fees has been adopted by this office for civil suit filings in Jefferson Parish.

***Effective October 1, 2015, the Domestic Enforcement of Support filing fee ($35 in certain instances) [La. R.S. 46:236.5; 24th JDC Local Rules for Domestic Court 35.4] is replaced with the 24th JDC Domestic Early Intervention Triage (Domestic Commissioners)[filing fee ($35 on certain domestic filings)[La. In some instances, a larger advance deposit may be required for litigation that includes multiple plaintiffs or defendants and lengthy pleadings.  These advance deposit amounts are only a guide, and typically include only one service.  With few exceptions, the following new suit and domestic suit costs include one service.

Subsequent Filings
When filing a pleading or other documents into a suit that has already been established, one must consider many factors when determining cost, as every pleading is different. A filer should consider these when attempting to estimate costs: 1) pages to the pleading; 2) pages of exhibits; 3) litigants filer is requesting to be served; 4) certified copies the clerk will need to perform issuing; etc. The base filing fee for any pleading is $7 for the first page and $5 for each additional page. Appeals
Motion for Appeal (Includes notice to two attorneys, filing of the appeal court’s decision, and issuing the cost estimate.)  The clerk of court will issue an Estimate of Appeal Cost which will include the costs for transcripts, the La. Fifth Circuit Court of Appeals filing fee, and record duplication. $200.00
Refund of Unused Court Costs
Occasionally, the entire amount advanced is not used up during the life of the suit. As of May 3, 2016, the clerk of court had refunded to the public $30,488,023.54. (since 1988). The clerk of court’s office issues refunds upon request, at the conclusion of the case, and upon the case being inactive 5 years.  Refunds from civil case activity will be issued upon request. However, outstanding balances from other cases will be satisfied accordingly. Please call (504) 364-2912 if you have any questions about civil case refunds and billing.

Pursuant to La. R.S. 13:843.1, the clerk of court provides a refund of any unused balance remaining in the clerk’s advanced deposit fund on a particular case not later than 90 days after receipt of written verification of final termination of a civil suit. Written verification of the final termination of a civil suit is an order or judgment dismissing the case. If there is no order or judgment of dismissal in the record of the case, a refund may not be issued.  ***NOTE*** Before a refund is issued, the clerk of court conducts a thorough review of the case activity.  Charges often are adjusted to ensure that all services were accurately billed.  The docket ledger balance provided on JeffNet is only an estimate, and certain costs for issuing the refund will assessed, including postage (La. R.S. 13:841). 

A Note About Service Copies: If service of a pleading is required, the Clerk’s office must certify TWO service copies of said pleading. Certification costs for each service copy are $5.00 per document. If the Clerk’s office has to make the copies, certification costs are $5.00 per document plus copy cost. If the clerk’s copies can be computer-generated, the cost is $.50 per page ($.75 effective July 1, 2014). Otherwise, the cost is $1.00 per page. When filing, please provide extra copy for return to your office with a self-addressed stamped envelope.

Criminal Divisions – 24th Judicial District Court, First Parish Court, Second Parish Court

Pursuant to La. R.S. 13:847 and La. R.S. 44:9, the Jefferson Parish Clerk of Court is entitled to collect fees for services performed by its criminal records division clerks.  Fees for filings enumerated in the statute are collected post-conviction by the Jefferson Parish Sheriff from defendants who have been cast with fines.

The clerk of court’s office provides copies and services to law enforcement agencies (government) and to indigent defendants and their attorneys at no charge.  The general public, defendants who are not indigent or who have not been placed on a inmate payment plan, and attorneys who are not representing an indigent defendant are required to pay for the following services.

Photocopies [La. R.S. 13:847(A)(3)]:  $.75 per page (printed from imaged document)/$1.00 per page (copied from hard-copy case folder) Conformed copies (clocked, not certified) [La. R.S. 13:847(A)(8)]:  The clerk of court’s mail processing division has developed a schedule of postage costs based on weight of documents prepared for mailing.  Minimum cost:  $.46 per mailing, subject to change without notice. Fax Filing:  Pursuant to La. Code of Criminal Procedure Article 14.1(3), the Jefferson Parish Clerk of Court is entitled to collect a $5 transmission fee for documents transmitted to the office for filing via facsimile in addition to service fees enumerated in La. R.S. 13:847. EXPUNGMENTS (Felony or Misdemeanor): $300.00 Provide completed forms along with cash, credit card, or one check (business/personal), or U.S. Postal Service money order made payable to “Jefferson Parish Clerk of Court” AND one U.S. Postal Service money order in the amount of $250.00 made payable to “La. State Police.” EXPUNGMENTS (DWI):  $600.00 Provide completed forms along with cash, credit card, or one check (business/personal) or U.S. Postal Service money order in the amount of $300.00 made payable to “Jefferson Parish Clerk of Court”; one U.S. Postal Service money order in the amount of $50.00 made payable to the “La. Marriage Licenses & Passports

Marriage Licenses

The cost to obtain a marriage license is $27.50.  ***Effective Monday, August 1, 2016, the fee is $28.00.***; certified copies of a marriage license are $10.00 each; un-certified copies of marriage licenses are $5.00 each. If a waiver is required there will be an additional fee of $2.50 per waiver. Cash, money order, personal checks, or certified or cashiers checks are accepted. We are planning to provide for payment by credit card or check card in the very near future. By Louisiana law, the clerk of court transfers over forty percent of the above fees to the program for the Program of Victims of Family Violence.

Passports

The cost is $110.00 for those age 16 and older ($170.00 for expedited service). To ensure your passport arrives within the two-week period, an additional fee of $12.85 is required for overnight express mail service. (This passport is normally valid for 10 years from the date of issue). The cost is $80.00 for those age 15 and younger (This passport is normally valid for 5 years from the date of issue) (expedited service is $140.00). To ensure your passport arrives within the two-week period, an additional fee of $12.85 is required for overnight express mail service. Fees are payable in check or money order to: “U.S. Dept. of State.”The passport renewal fee is $110.00 per passport for standard service ($170.00 expedited service), and must be mailed to the address on the application. To ensure your passport arrives within the two-week period, an additional fee of $12.85 is required for overnight express mail service. The $25.00 execution fee does not apply to renewals. Children’s passports (if issued under age 15) cannot be renewed.A $25.00 execution fee per passport, payable in cash, money order, or check is due the clerk of court. The clerk of court, however, is preparing to implement a credit card alternative to cash. The fee for the clerk of court’s passport photo service is $10.00. Checks and money orders for fees due the clerk of court should be made payable to “Jefferson Parish Clerk of Court”.

Mortgage & Conveyance

JeffNet users may have filings charged to their account provided that the JeffNet account is supplied with written instructions to make the charges. To: Civil filers Re: Request for jury trial La.R.S. 13:3049.1 in pertinent part provides: “E. (1) When a civil party litigant prays for a jury trial, a jury filing fee in the sum of $150.00 shall be paid at the time of request (emphasis added). The jury filing fees shall be retained (emphasis added) and assessed as costs of court for the operation of the jury commission.” Accordingly, the said deposit is nonrefundable, irrespective of whether or not the case is set for jury trial.
