Policies and Procedures to Prevent Sexual Harassment
Pursuant to La. R.S. 42:343, all public servants must receive at least one hour of sexual harassment prevention training annually, and each agency must post its policies and procedures on its website.
Policy
It is the policy of the Clerk of Court to prevent and prohibit sexual harassment of any employee by another employee, by supervisors, by customers, or by vendors. The clerk’s office will not tolerate sexual harassment. Unwelcome sexual advances, requests for sexual favors, and other verbal, physical, or inappropriate conduct of a sexual nature constitute sexual harassment when the conduct explicitly or implicitly affects an individual’s employment, unreasonably interferes with an individual’s work performance, or creates an intimidating, hostile, or offensive work environment. Violations of this policy may result in discipline up to and including termination.
Prohibited Conduct
Sexual harassment includes any unwelcome physical contact, sexually explicit language or gestures, and uninvited or unwanted sexual advances (physical or verbal) that create an offensive environment. Examples include, but are not limited to: use of vulgar language; presence of sexually explicit photographs or materials; telling of sexual stories or jokes; and uninvited touching. Both men and women can be victims of sexual harassment, and the victim need not be of the opposite sex of the alleged offender.
Reporting, Investigation, and Resolution
Any employee who believes he or she is a victim of sexual harassment should report the matter to his or her immediate supervisor or, if circumstances do not permit, to any supervisor. The supervisor receiving the report shall immediately have the reporting employee reduce the complaint to writing, including: the name, department, and position of the alleged offender; a description of the incident with date and location; and the names of any witnesses. The supervisor shall also notify the Director of Personnel and forward the written complaint.
If reporting to a supervisor is not possible, the employee should report directly to the Director of Personnel. If that is also not possible, the employee should report to the Chief Deputy Clerk of Court.
Complaints should be submitted as soon as possible after the incident. The Director of Personnel shall investigate promptly and thoroughly, and shall take appropriate action. Investigations will be conducted confidentially, with information shared only on a need-to-know basis. The complaint, investigation, and any resulting disciplinary action shall be documented. Discipline for policy violations may range from a written reprimand to termination of employment.
Prohibition Against Retaliation
This policy prohibits any retaliation against any individual for making a complaint or for participating in any investigation or proceeding related to a complaint of sexual harassment.
Federal and State Law
Sexual harassment is a form of sex discrimination prohibited by federal and state law, including Title VII of the Civil Rights Act of 1964, La. R.S. 51:2231 et seq., and La. R.S. 42:341 et seq. (effective January 1, 2019).
