When filing a pleading or other documents into a suit that has already been established, one must consider many factors when determining cost, as every pleading is different. Refund of Unused Court Costs | ||||
Occasionally, the entire amount advanced is not used up during the life of the suit. As of October 31, 2019, the clerk of court had refunded to the public unused costs totaling $54,085,713.64.
Since 1991, the Jefferson Parish Clerk of Court has maintained a policy of issuing refunds of advance deposit costs to attorneys of record or pro se litigants in civil cases pursuant to Louisiana law. La. R.S. 13:842(B) states, in part, that refunds shall be issued “if a period of five years elapses without any pleadings being filed and the suit has been completely inactive during this five-year period…” The clerk may determine, by examination of the docket, whether pleadings have been filed within five years. In many instances, the clerk cannot determine if a case is also “completely inactive.” In fact, the clerk of court has received a return of refunds from law firms who have indicated that a suit was not “inactive” due to discovery or other matters handled outside of court records. In those instances, the funds are returned to the docket. However, the clerk of court has taken the position that neither statue prohibits the refund of deposited funds at any time during litigation, and has established policies and procedures for the return of civil suit advance deposit funds. Although in La. R.S. 13:842(B) probate matters are “specifically excepted,” the clerk of court includes such case types in its refund procedures. La. R.S. 13:843.1 states, in part, that for a case to be considered eligible for a refund, the clerk of court must receive written verification of final termination of the suit. Although not required by law, in the interest of the civil litigants who have deposited funds with the clerk of court, the clerk has established internal criteria to issue refunds as follows: 1) five years have elapsed since any pleading or other document advancing the case has been filed into the record; 2) final termination of the suit; or 3) upon request of the attorney of record or pro se litigant. Before the clerk of court issues a refund, a deputy clerk performs an examination of the suit’s docket ledger to ensure that all charges were applied appropriately and according to law. As the clerk of court is the fiduciary for collection of civil court costs, he must pay 10 or more government agencies certain proceeds from civil advance deposits. Suit balances reflected on JeffNet and in the clerk’s civil docket information system typically need adjustment before a refund check may be issued; figures presented there are an estimate of funds remaining on account. Refund checks are issued monthly to the attorney of record for each litigant or the party whom advanced the funds for the suit. In recent years, the office has streamlined its refund procedures: 1) with software enhancements; 2) by dedicating more resources (personnel) to the effort; 3) by establishing workflow procedures that have led to refunds being issued more quickly; and 4) the completion of back-imaging of all civil case folders (a four-year project completed in 2018). The clerk of court has consulted both its internal auditor and legal counsel to establish said policies and procedures. A Note About Service Copies: If service of a pleading is required, the Clerk’s office must certify TWO service copies of said pleading. Certification costs for each service copy are $5.00 per document. If the Clerk’s office has to make the copies, certification costs are $5.00 per document plus copy cost ($1.00 per page). When filing, please provide an extra copy for return to your office with a self-addressed stamped envelope to avoid mailing charges. | ||||
To: Civil filers Re: Request for jury trial La.R.S. 13:3049.1 in pertinent part provides: “E. (1) When a civil party litigant prays for a jury trial, a jury filing fee in the sum of $150.00 shall be paid at the time of request (emphasis added). The jury filing fees shall be retained (emphasis added) and assessed as costs of court for the operation of the jury commission.” Accordingly, the said deposit is nonrefundable, irrespective of whether or not the case is set for jury trial. So, I suggest that you apply for jury trial only after you are substantially certain that you want one … within the time limit imposed by law, however. Pursuant to La. R.S. 13:847 and La. R.S. 44:9, the Jefferson Parish Clerk of Court is entitled to collect fees for services performed by its criminal records division clerks. Fees for filings enumerated in the statute are collected post-conviction by the Jefferson Parish Sheriff from defendants who have been cast with fines.
The clerk of court’s office provides copies and services to law enforcement agencies (government) and to indigent defendants and their attorneys at no charge. The general public, defendants who are not indigent or who have not been placed on a inmate payment plan, and attorneys who are not representing an indigent defendant are required to pay for the following services.
Photocopies [La. R.S. 13:847(A)(3)]: $1.00 per page; Conformed copies (clocked, not certified) [La. R.S. 13:847(A)(4)]: $3.00 per copy; Certification of copies [La. Code of Criminal Procedure Article 14.1(3), the Jefferson Parish Clerk of Court is entitled to collect a $5 transmission fee for documents transmitted to the office for filing via facsimile in addition to service fees enumerated in La. The cost to obtain a marriage license is $27.50. Certified copies of a marriage license are $10.00 each; un-certified copies of marriage licenses are $5.00 each. If a waiver is required there will be an additional fee of $4.00 per waiver. Cash, money order, personal checks, certified or cashiers checks and credit or debit card are accepted. We are planning to provide for payment by credit card or check card in the very near future. By Louisiana law, the clerk of court transfers over forty percent of the above fees to the program for the Program of Victims of Family Violence. |

U.S. Department of State Passport Fee Calculator
Routine Service is currently about 7-10 weeks and Expedited Service is 3-5 weeks. Fees are established by the U.S. State Department. The cost is $130.00 for those ages 16 and older using Routine Service. If you would like your passport to be expedited the following fees will apply ($130.00 Passport, $60.00 for Expedited Service, and an optional fee of $19.53 for overnight return totaling $190 or $209.53). (This passport is normally valid for 10 years from the date of issue). Also optional, is a Passport Card for an additional fee of $30.00. The cost is $100.00 for those ages 15 and younger using Routine Service. If you would like the passport to be expedited the following fees will apply ($100.00 Passport, $60.00 for Expedited Service, and an optional fee of $19.53 for overnight return totaling $160.00 or $179.53). (This passport is normally valid for 5 years from the date of issue). Also optional, is a Passport Card for an additional fee of $15.00. Fees are payable in check or money order to: “U.S. Dept. of State”. The passport renewal fee is $130.00 per passport for Routine Service ($190.00 or $209.53 Expedited Service), and must be mailed to the address on the application by the bearer. The Clerk of Court cannot do Renewals. Children’s passports (if issued under age 15) cannot be renewed. You must get a new passport every 5 years. A $35.00 execution fee per passport, payable in cash, money order, check, debit, or credit card is due to the Clerk of Court. The fee for the Clerk of Court’s passport photo service is $10.00. Checks and money orders for fees to the Clerk of Court should be made payable to “Jefferson Parish Clerk of Court”. ***NOTE – Per U.S. State Dept. regulations, applicants must submit the certified copy and 1 photocopy of your birth certificate and/or original naturalization papers when you submit your application.
